Contractual Liability of the Transmission System Operator.

The Greek Transmission operator (ADMIE S.A.), represented by our office, wins a multi-million dispute with one of the largest Energy Producers.
The dispute concerned the alleged liability of the Transmission System Operator for overdue debts regarding the supply of both energy and balancing services in the wholesale market. The Athens Court of Appeal with decision n. 952/2018 asserted that although in the frame of the Greek electricity market the Transmission System Operator acts as an intermediary and a clearing agent in terms of a number of transaction, that does not render him neither a buyer or seller of energy nor a central counterparty of the said transactions. It therefore rejected the appeal thereby upholding the decision of the first instance court (dec. n. 703/2016).
